Terms of use

Purpose

These terms govern the use of texts, photographs and documents (hereinafter "the Content") made available on the "press.st-martin-belleville.com" website, published by the Saint-Martin-de-Belleville Tourist Office. The Content is the property of the Saint-Martin-de-Belleville Tourist Office or its partners, who have authorised it to grant use of the Content under the conditions set out below. Downloading any Content constitutes full and unreserved acceptance of these terms.

Beneficiaries

The Content is reserved for tourism professionals and media. Use of the Content by any person not falling within these categories is subject to the prior agreement of the Saint-Martin-de-Belleville Tourist Office.

Licence granted

The Saint-Martin-de-Belleville Tourist Office grants beneficiaries a free, non-exclusive, non-transferable licence, valid worldwide and until revoked, covering the rights of reproduction and communication to the public of the Content on all media (print, websites, social networks, newsletters, presentations, audiovisual media).

This licence is strictly limited to the promotion of the Saint-Martin-de-Belleville destination. Any other purpose requires the prior written consent of the Saint-Martin-de-Belleville Tourist Office.

Permitted adaptations

The Content may undergo technical adaptations necessary for its integration: cropping, resizing, compression, and layout. Such adaptations must not distort the work, alter its meaning, or harm the honour or reputation of its author, in accordance with the moral rights provided for in Article L.121-1 of the French Intellectual Property Code.

Mandatory credit

Each item of Content must be accompanied, legibly and in close proximity, by the credit "© [Photographer's name] / Saint-Martin-de-Belleville", as indicated in the Content's record and in the file name. Failure to include the credit constitutes a breach of these terms and of copyright.

Prohibited uses

The following are, in particular, prohibited:

• the resale, hire or transfer of the Content to third parties, whether for payment or free of charge;
• any commercial use unrelated to the promotion of the destination (advertising for a third-party product or service, generic illustration, stock image library);
• any use of a political, religious, controversial, disparaging or misleading nature, or contrary to the image of the destination and its partners;
• registering the Content, or elements extracted from it, as a trade mark, design or model;
• removing or altering credit or intellectual property notices, including within the file name.

Protection of the site

The site, its structure, its graphic identity, its presentational texts and its database are protected by copyright and by database producer's rights (Articles L.341-1 et seq. of the French Intellectual Property Code). Any reproduction, communication to the public or substantial extraction of the site or its database, in particular by automated means, is prohibited without the written authorisation of the Saint-Martin-de-Belleville Tourist Office. It is likewise prohibited to build a derivative image library from the Content, or to make the Content available on a shared space accessible to third parties who are not beneficiaries.

Rights relating to the image of persons and property

The Saint-Martin-de-Belleville Tourist Office states that it has obtained the necessary authorisations from identifiable individuals appearing in the Content, for the promotional use defined above. Any use falling outside this scope is the sole responsibility of the user, who must obtain the required authorisations themselves. Certain Content may depict trade marks, buildings or protected works, the use of which outside tourism promotion may require additional authorisations.

Withdrawal and revocation

The Saint-Martin-de-Belleville Tourist Office may, at any time and without giving reasons, withdraw any Content from the site or revoke the licence granted. The user then undertakes to cease all distribution and to remove the Content from their digital media within 15 days of notification. Printed materials already distributed are not affected.

Liability

The Content is provided "as is". The Saint-Martin-de-Belleville Tourist Office cannot be held liable for any use that does not comply with these terms, nor for any resulting damage. The user indemnifies the Saint-Martin-de-Belleville Tourist Office, its partners and the authors against any claim arising from such use.

Penalties

Any use that does not comply with these terms constitutes an infringement within the meaning of Articles L.335-2 et seq. of the French Intellectual Property Code and may give rise to civil and criminal proceedings.

Governing law

These terms are governed by French law. In the event of a dispute, the parties shall endeavour to reach an amicable settlement. Failing this, the dispute shall be brought before the competent court under the ordinary rules of jurisdiction, it being specified that actions relating to literary and artistic property fall within the jurisdiction of the judicial courts specifically designated by Article D.211-6-1 of the French Code of Judicial Organisation.
